The Tavern can still recruit pirates during an upgrade. Other buildings disable during an upgrade such as the Academy, Voodoo Hut, Flame Gates. If the Tavern is allowed to recruit pirates during an upgrade (yeah yeah, gameplay blah blah) then you should be allowed to upgrade the Tavern whilst recruiting pirates. Spoiler
